Default using others pics, is it legal

using others pics, is it legal? i found a great pic on the web. it has a planet crashing into another planet. i do not know who did it, it was on a few different sites. i used it for a background for my next dio chapter and then photoshopped some joes in it.i just wondering if this is legal?

As long as you host it yourself and state that it's not your picture, it's all good. Kinda like how Hammerfel was posting Hasbro images. He stated that they were Hasbro's images, not his.

From my understanding, you can do that as long as you're not trying to profit off someone elses work....so if your dios are free (as everyone's Are, at least no one has tried to charge me yet!) the it's all good!

I say just put in your dio somewhere that the photo isn't yours, and you should be good....the worse they can do is tell you to take it down!

This is correct.

If you're not making money off it, all is good. Also, if you change it more than 60%, all is even better, and you can make money off it. The only catch is if you use it to defame the original artist, like if I took Hasbro photos of Joes and Photoshopped them doing something lewd. then I could get in trouble. (unless I could say it was parody).
