This is aweful. An American I am, and proud to be one! BUT our Government has embarrassed me, I feel ashamed. Please watch this: CBS News

The Reason the law is in place is because during Combat, when Doctors are overwhelmed with casualities they have to make split second decisions on who to save and who to let die. If we allowed everyone to sue for every mistake they made, it would tie up all the Military doctors who ever had to preform triage in courts for years and years. We would lose more troops because the doctors would all be in court back in the US for every little decision they made.

This is one of those cases where that law protects those doctors in a case it wasn't intended to, but if we repeal the law, it will bog down our courts and our Militart Medical system and make things WAY worse. I think rather than repeal the law, they should make a review board to weigh the merit of each case, and go from there so the system doesn't get bogged down with bogus cases.

In a time of war in a battlefield hospital that is understandable (this is not a battlefield case of "pump them full of morphine and give them to god") but blatant negligence is not. That is why it should be determined in a court of law. If Military Doctors are not held responsable for their blunders, they can literally "get by with murder" with no repercussion. And the family has to pay for the funeral - SHAMEFUL!!!!! Damaged Soldiers should be able to sue for incompetence. As far a the courts bogged down, that is not an excuse for justice. The government passed a law to cover their asses, pure and simple! The courts are already bogged down with frivolous civilian lawsuits. A simple way of clearing civil courts would be to make the plaintiff pay for the defendants legal fees & all courts cost if the defendant wins the lawsuit, that would stop alot of the crap! This man is dead, it could have been prevented, his family deserves more than 55% of his benefits and the bill to bury him!

Another example of the World's Priorities being somewhere they shouldn't. Absolutely Disgraceful.

Vader9900, Agreed. That's why I said

"This is one of those cases where that law protects those doctors in a case it wasn't intended to"

The law needs to be rewritten to keep stuff like this from happening.
